DUI Lawyer??

.06 and still got a DUI how does that work? That's not right!

Well when you get charged with DUI in California, there are two sections you can potentially be charged with. They are V.C. 23152(a) which is simply driving under the influence of alcohol or a controlled substance. Then the second section is V.C. 23152(b) which is having a blood alcohol level of .08 or above while driving under the influence of alcohol or a controlled substance. Just because you blew under a .08 doesn't mean that aren't impaired. So just because you were a .06 doesn't mean your free from being charged with just misdemeanor DUI.

Now on the positive end, because you were not .08 or above BAC you may have more leverage in court to get that misdemeanor DUI "knocked down" to a "Wet/Reckless". Most auto insurance companies look at DUI and a "Wet/Reckless" the same, but if you can get it knocked down to that you might be better off.

you could be under .08 and be charged with DUI by the way you are driving. If you are driving in a manner that can be judge as debilitating or can be hazardous to yourself or other people, any alcohol in your system can be charged as DUI in this situation.

Best of luck in your defense against DUI. I'd suggest "Franklin and Bash" but I hear they normally do not take such cases. Keep your chin up and hopefully everything will work out in your favor!!!

I think its clear what is wrong and right. I'm also sure that he will be hearing enough from his chain and doesn't need any negativity. I've been there and it sucks. I blew a .04 in Jacksonville and was also charged back in 2010. I got out ok no NJP.

In California the limit has lowered to .06. If you blow anything over a .04 they can still say you were intoxicated if you are slurring words, stumbling, pupil dilation, swerving, ext.......

I saw your car for sale the best thing to do is make it right at work and step it up at work to even the balance. I know the looks and disappointments are unbearable at times. But, as with all huge set backs only time can heal. I know that they tell you that multiple good deeds can be ruined by one bad decision, and that's true. But, it only last for so long. I recovered from mine, smoked my exams and got EP's and am back on track. Don't let them tell you that its over because its only over when you quit.

You need to get to that lawyer soon and get this dropped before your commands starts throwing punches. If they haven't already sent you to CPO mess. Get it dropped before XOI and your in the clear. We all make mistakes as I did almost five years ago. My advice is just take the punches as they come as to the dui. It's your first offense it won't be as bad as mine was. I blew a .17 so I know how you are feeling. Just go to court do everything you have to and you'll be good. Stay up man
